Outside of the EEZs, a sparse and time-sensitive patchwork of legal frameworks governs the Arctic Ocean&#8217;s high seas.</p>

<p>More recently, the UN High Seas Treaty was adopted, the first ever legally binding treaty governing international waters. Although a promising step, the Treaty has significant gaps. For example, countries can veto MPAs and continue fishing or drilling unpenalised. <p>Deep-sea mining is also a concern for the region, which is rich in polymetallic nodules. <p>MPAs, however, are difficult to enforce and can be ineffective if incorrectly implemented. For example, China&#8217;s self-imposed squid fishing bans are failing, according to a <a href="https://cKf4804.na1.hubspotlinks.com/Ctc/OP+113/cKf4804/VW_YtK88f9r-W60_hc07tqwDRW197v5Z52TDWxN35KTCK3m2ndW7Y8-PT6lZ3lxW82RvjT7FVl2wW4kt1dK906PZ6VP73pk23vpFnVVyMCL4l6yfrW1Ckjk56Q11W_W43BDQX1vvxy2W8Xtms13T_gd1N3gYWpKWy_ZLW9dPw6b5QlsRPW6hlJvR5H_M_xW1sbHqL8bJcp5W4R3x3Q8qnG5lW71hQC74fq3F5W2ctTc44nXb6CW94rmwS4WwndQW4FDdzq1k5lr5N3vf1qkN5HJmW70jZ6H2xrvTXW2nVqK91zqKX1N6RvrW5vt9dQW2RSLC23svpVzW8StHTD975rgxW3DpX2W3qmtLQW8fRkfR8wTyWFW1slKBL6lC7kDW7vpGhS7s1Phnf1DL_yq04" data-hs-link-id="0">report</a> by Oceana. <p>Creating a successful and effective Arctic MPA hinges on collective action at the global scale. Despite its flaws, the UN High Seas Treaty serves as a positive reminder that international collaboration on marine conservation is possible.</p>

A lack of regulation on the high seas has led to over-exploitation, pollution, and habitat destruction.</h4>

The 2022 <a href="https://ckf4804.na1.hubspotlinks.com/Ctc/OP+113/cKf4804/VXjXT04LV25BW85vWLT2xm00DVkMXxJ4YPJz7N7TcW3m3lScZV1-WJV7CgZfRW5_N69d8y7J1NW94WSWF2v4BR6W4Qm4gz7Btg-XW2m71c17ZkXwbW3Xq-yt2K4np7W71VNzp87R19WW21vsjg1crWGlVL9Ds86rKYGJW2W1bTf1T8RKtW1bXyx11q4dPGW3c2Q0c9lGP9pW4ffs4t8GY-8NW54FFrg6d6-RxW3gnx962Bb4HnW1LZChN1hN90WW6dYwwG3zrXgNW3GyZgS64ffqZW5zHSfk2jFsLGW3v0qYx1DLk9NW4g5pPg8hNBCrW1K6fky2HPFSHN1Qmpy97NqBwW5gC8_T3-ms8VW3wFZ056vsFsdW3mD6nT2ZrfkWW38PP8x77JGcGW9cBCp68kX7b8W1sch046M2YFlVvp-cj606-0LW1wq6ZT4wB6BG31Yd1">IUCN Red List</a> report found that 10% or 42,108 marine species are at risk of extinction, with 41% of those also affected by climate change. Worryingly, this figure is likely to be far higher – just 67% of fishes, 15% of reef corals, 11% of molluscs and 0.1% of green algae have been assessed for extinction. Species may be lost before they can be added to the Red List. The <a href="https://ckf4804.na1.hubspotlinks.com/Ctc/OP+113/cKf4804/VXjXT04LV25BW85vWLT2xm00DVkMXxJ4YPJz7N7TcW2t3lSc3V1-WJV7CgPDWW8JfFVs1vH74DW6nT3ym7_QZDJW7jNTy17HjQcSW2b11s-4llv-HW71fXQm9hlQdZW4Fz6TR82-qSMW3Sg7Sb4b9kY6W8LFK8w7SFfY6W6Yj1dJ79-cP8W2VVWDr2ZxCJqW88QnHt99ZqDmW3HgYn752l79jW6GKxqn2bTghQN2zhRzw4yYBDW6kDNsN4cVvwgW8C7gxP3qwM06W6Jg0Kt3qqNS3N4y6NN4DGZ4GW44Rckp7nlhp1N4wTvhSm66vlW69vbnn6FbXxzW2KHWsh7cQZPFW4kTXS7129FwqW79QWPs7jPmLh36Zp1">30&#215;30 Pledge</a>, made at the UN Biodiversity Conference in December, is an agreement to address this issue by protecting a third of land and sea by 2030. Without the High Seas Treaty, the 30&#215;30 pledge would likely fail.</p>
<p>These include the formation of marine protected area (MPA) legislation, the equitable sharing of genetic resources and the requirement of environment impact assessments (EIA&#8217;s) for countries considering large ocean projects. However, as is often the case with international agreements, each comes with caveats.</p>
<p><strong>Marine protected areas</strong> – Currently, only <a href="https://www.bbc.co.uk/news/science-environment-64839763?utm_medium=email&amp;_hsmi=252370364&amp;_hsenc=p2ANqtz-8IIociLH4ZojVlInAkC-UZnDBLA2w8-QEvZfHIg9a70rYwI1dAXNZbsny_xo6OdEpoBKGZl-nQHgAp429k3EkazQPmsQ&amp;utm_content=252370364&amp;utm_source=hs_email">1%</a> of the high seas are protected, leaving marine life at risk of overfishing, shipping traffic and the effects of climate change. Protecting the high seas has previously been inherently difficult. However, the treaty establishes formal legislation, creating a legal framework for the creation and enforcement of MPAs on the high seas for the first time. Countries will be able to propose areas for protection which will be voted on by signatories of the <a href="https://ckf4804.na1.hubspotlinks.com/Ctc/OP+113/cKf4804/VXjXT04LV25BW85vWLT2xm00DVkMXxJ4YPJz7N7TcW333lScGV1-WJV7CgCKxW3-1Qtm3xSTGqW7KjryT4jNKGXW3vfdbW58GDXdW5pSPM73TWFWxW683fBt8rT_92W51wXMr6Qk043W68DNNH3FKK_zW47f5SG15B91RW2mF7p72-24WYW9f4Z178PT5WtW17Tdxy3y9_6qN7yLY65V7hJ_W3g_zZq1QRZGFW7LpYjt8xzXSFW6Lt7Hy2KVNFhW3rPyRh2Qy6cxW91n0tD822HZdW19BL8M2yr9h7W5ZlbGq5kZ7p1W1VmJn47T83cXW6bLQC61gJ1hGW4j184L4ZzNMLW3s0tln5MZQ-KW3f7WQz6G20GfW2TSXDn6bhLHQW6sNdMm3R8DxTN25kL4p8050jN4S6_5N_VbKC3kBK1">treaty</a>.</p>
<p><strong>Genetic resources</strong> – Marine <a href="https://ckf4804.na1.hubspotlinks.com/Ctc/OP+113/cKf4804/VXjXT04LV25BW85vWLT2xm00DVkMXxJ4YPJz7N7TcW333lScGV1-WJV7CgNfrW3Z0fk61M4b5MW4ZZhJv3gJNKmN6ml5DWhNx9VW7kTKh_3Q_jCRW7hGyW-3LDshBW2c89Zf8RptZtW6w5dRl6M4BNgW76BLmd7xllVGW1bTznM7-Sxq2W794ZXC4MRMc4W8TXCdZ6mQK-pVxyYmL5MF_X8W6dPMK425VQ4gVt0mrr4pHB2pW7k55794ZpfT6V7c4gr8L7hDYW5RWwN07msk8DW3XqMR178Mg89W2KfRrB98-kP-MtZ8hZ-jN-hW3J_3Pw5rFKsyW4hk11m5j-FGFVQQtnh2zz0ZzW87Lw3d8zfdrFVCXb-G4yq7H2N9dh5c0S8M8yW916wCg1NR2PyW5GVz1d2H2Fxw3bYY1">genetic resources</a> include any genetic plant, microbial or animal found in the sea that has actual or potential value, for example, krill, coral sponges, or seaweeds. Marine genetic resources are already generating revenue for pharmaceutical companies and garnering scientific attention, with more uses expected to emerge in the future. The management of these resources and the profit they generate was a contentious point. However, an <a href="https://ckf4804.na1.hubspotlinks.com/Ctc/OP+113/cKf4804/VXjXT04LV25BW85vWLT2xm00DVkMXxJ4YPJz7N7TcW293lSbNV1-WJV7CgY4HW5VN-4d5SXCvwW776KNp86Cv40W5Z5wMX8q4JNXW1X1Jpg7V511PVXDc1_2TVg07W3V5YXc3r7ytzW1mMcqd3dZYJ7W2X1mXG90TmHTVvky9_43c1fvW5b8W2H7RJrprW8Lm8VD2j0gd7N6hvpMHcVFXqW450v168JXhvQW38Dy614GHn4mTSh9Q4NGNSpW5j2XNq8qpdTYW3ywKPm7mV8KBW87ybx03LhXCxW372Qpg35JRZvW1y_dcr84mYvpW2vkkRW5McGRpW64nhKw10HMcx3c451">agreement</a> was made that countries will be permitted to gather resources under the condition that profits are shared equitably. The details of this arrangement are yet to be finalised; however, a share of profits will go to a global marine conservation fund, with richer countries contributing a higher proportion.</p>
<p><strong>Environment impact assessments</strong> – The EIA section comprises the longest part of the UN High Seas treaty and was at the centre of negotiations. This legislation covers high seas and national waters, meaning countries that wish to conduct activities that could cause &#8220;substantial pollution&#8221; or &#8220;harmful changes to the marine environment&#8221; within their jurisdiction will need to complete an EIA. These assessments quantify potential damage whilst advancing our understanding of ocean ecosystems. However, EIAs are expensive and require array of technology and expertise, making it difficult for poorer nations.</p>
<p><strong>Issues unaddressed</strong> – Although positive, there are holes in the treaty. Firstly, protected areas cannot be placed in areas with existing fishing agreements, regardless of their sustainability or fishing methods. Additionally, countries that oppose MPAs are exempted, meaning they can continue environmentally damaging practices within them.</p>
<p>Secondly, the treaty does not overrule authorities that oversee existing activities. Organisations including the International Seabed Authority &#8211; whose director was recently <a href="https://www.theguardian.com/environment/2023/mar/21/row-erupts-over-deep-sea-mining-as-world-races-to-finalise-vital-regulations?utm_medium=email&amp;_hsmi=252370364&amp;_hsenc=p2ANqtz-8K9N63TmuJrHQ6RohARbyPOuG5SZU9Wy1Z0xor0tYkv8AFCMjAepAZ-mRNEGetgerRpy71Rkuiu3RZlLVzosCthhJYMQ&amp;utm_content=252370364&amp;utm_source=hs_email">accused</a> of abandoning neutrality &#8211; remain in control of existing deep-sea mining projects. A recent <a href="https://www.fauna-flora.org/news/damage-caused-by-deep-seabed-mining-would-be-extensive-and-irreversible-reveals-new-fauna-flora-report/?utm_medium=email&amp;_hsmi=252370364&amp;_hsenc=p2ANqtz-8EInN-k3BkoId_5NbtecoV4_IEsIqH8qxuPzJpAoQrDuQMTwaCq5pMksDsD3utL4OPBcuB8h2CTU9DoK1225DL5WZbBg&amp;utm_content=252370364&amp;utm_source=hs_email">study</a> found deep-sea mining to be highly destructive to ocean ecosystems that are typically undisturbed, causing irreversible damage.</p>
<p>Critics also argue the treaty does not address overfishing. Overfishing is a major diver of dwindling fish numbers and high extinction rates – in 2017, 34% of fish stocks were <a href="https://ourworldindata.org/fish-and-overfishing?utm_medium=email&amp;_hsmi=252370364&amp;_hsenc=p2ANqtz-_MSrKNsH9M1Pk2NJS8f94M01hg_zkJziY7-GM3fg0QdXtK5Vw_JJEi554Y_uHsqSjdQmXh8W2KnPJo3KJTQctuvcBZJA&amp;utm_content=252370364&amp;utm_source=hs_email#what-does-sustainable-fishing-mean">overfished</a>. However, the words &#8220;fish&#8221; or &#8220;fishing&#8221; are only mentioned 6 times in the treaty, all falling under the genetic resources section, whereby any existing fishing practices are exempt.</p>
<p>Finally, the treaty overlooks many of the symptoms of problems in the ocean. These include on-land nutrient pollution, leading to vast &#8220;<a href="https://education.nationalgeographic.org/resource/dead-zone/?utm_medium=email&amp;_hsmi=252370364&amp;_hsenc=p2ANqtz--VPErXAjXMiHZD2PMya8SGCZCdQD_Isw1fes90ZQYH-zS6ah06bJ9_LJDUVBG5NDQ9HUh03Oru5lewp3xlKzI-nPPR8A&amp;utm_content=252370364&amp;utm_source=hs_email">dead zones</a>&#8220;, or government subsidies, one of the main drivers of overfishing. A recent study <a href="https://ckf4804.na1.hubspotlinks.com/Ctc/OP+113/cKf4804/VXjXT04LV25BW85vWLT2xm00DVkMXxJ4YPJz7N7TcW293lSbNV1-WJV7CgSs-W427Nsc2ZZTPgW3hzxh679HGgCN5d8mDyz9dS9W4g-4m03ll6VXW684zq65DnkRYW3rpY401rHfbtN1K8gP3GJY5PW4_JWdS5Hp3M6W1QQrDp3D9B5BW7Ysmwx4GBRJYW465qST6wcQBzW4Z0_l03CXc5SW8WGyS-2j3pKNW3MHyX-8DL0k8N5lLN71nBZRzW4Z43k_26D7tSMHpKwKVGWq1W5J795Q61lsSrVQGdNd4nN6xCW3Fwymp148hg4W8bvkFd4SgSL7W3C3mwP36GPG53q4c1">found</a> that over half of the high seas fishing grounds would not be profitable without government subsidies. In most cases, bottom trawling – seen as one of the most damaging methods of fishing – is only profitable due to subsidies.</p>
<p>The High Seas treaty represents a positive step for global ocean governance, demonstrating collaboration at a time of bitter international relations. The treaty, however, is only the first step, with more work to be done in order to combat the serious drivers of ocean decline.</p>

The 30&#215;30 target grabbed headlines worldwide, seeking to conserve 30% of the world&#8217;s lands, inland waters, oceans, and coastlines by 2030. These developments may increase the demand for high-quality blue carbon credits as a greater volume of companies seeks trustworthy, impactful credit schemes to avoid accusations of greenwashing. </span></p>

There are examples of successful schemes in various countries. In southern Kenya, for instance, the <a class="_3Bkfb _1lsz7" href="https://ckf4804.na1.hubspotlinks.com/Ctc/OP+113/cKf4804/VW0tN5317z3kW1ZSPSS1GN9mfW7zr5cm4WskHzN3S9PGw3lSbtV1-WJV7CgVvjW7m5Jyp2k22Z3VBn09m4_X9SnW4TWfN_6RCqnwN6N5hkkFdypLW2fychP8w784MW8Q0kj78_D_6zW4-cfhG8z2svpW7q1cF11z5PTlW7sGW_22Y0PRpW15D9s52v9W94W5rTt5M8DYsnzW320q1V5wvz6rW63bPS33Zqp_9W77tYd45Kb2ScW976wjr6nStZxW4nPrbH7PVTx1W3L25Cc1W0KKxW7Mvtj86d330FW2CDCsp7m3cWCW6D4jLk8QnNYd31Qk1" target="_blank" rel="noopener noreferrer" data-hook="linkViewer"><u class="_3zM-5">Mikoko Pamoja</u></a> project has successfully planted 56,000 trees, restoring 117 hectares of mangrove forest. Commercial fishing within the reserve is banned, while additional measures including officer patrols, surveillance flights and US coastguard vessel visits also deter illegal fishing activities. </span></p>
